CONCERNING
AMENDMENT TO THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE
No. 230/MPP/Kep/7/1997
ON GOODS SUBJECT TO THE IMPORT TRADE SYSTEM

THE MINISTER OF INDUSTRY AND TRADE,

Attachment

Considering :

• a. that the ozone layer is badly required for the conservation of the environment, the protection of human health, the life of animals and vegetation, and the prevention of global warming;
• b. that in order to protect the ozone layer, the realisation of industrial and trade development must take care to avoid the procurement of substances and their use which can cause depletion of the ozone layer;
• c. that in connection with the above matters, it is necessary to stipulate a ban on the import of substances depleting the ozone layer and goods using such substances by supplementing Attachment I to the Decree of the Minister of Industry and Trade No. 230/MPP/Kep/7/1997 on goods subject to the import trade system;
• d. that for this purpose it is necessary to issue a decree of the Minister of Industry and Trade to this effect.

In view of :

• 1. Law No. 23/1997 on the management of the environment (Statute Book of 1997 No. 68, Supplement to Statute Book No. 3699);
• 2. Presidential Decree No. 23/1992 on ratification of the Vienna Convention for the Protection of the Ozone Layer and Montreal Protocol on Substances that Deplete the Ozone Layer as adjusted and amended by the Second Meeting of the Parties;
• 3. The Decree of the Minister of Industry and Trade No. 230/MPP/Kep/7/1997 on goods subject to the import trade system as already amended by the Decree of the Minister of Industry and Trade No. 25/MPP/Kep/1/1998;
• 4. The Decree of the Minister of Industry and Trade No. 110/MPP/Kep/1/1998 on the prohibition against the production and trading of substances depleting the ozone layer and the use of ozone depleting substances.

DECIDES

To stipulate:

THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE CONCERNING AMENDMENT TO THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 230/MPP/Kep/7/1997 ON GOODS SUBJECT TO THE IMPORT TRADE SYSTEM.

Article I

To amend the Decree of the Minister of Industry and Trade No. 230/MPP/Kep/7/1997 as follows:

1. To amend Attachment I by supplementing it with the list of ozone depleting substances and the list of goods using ozone depleting substances subject to an import ban, as contained in Attachments I and II to this decree.

2. To include Article 5A, Article 5B and Article 5C between Article 5 and Article 6, which shall read:

"Article 5A

The import ban on substances and goods as meant in Attachments I and II to this decree shall be effective as from the date of stipulation of this decree. "

"Article 5B

(1) Especially for after sale service, refrigerators under HS Number 8418.10.000, 8418.21.000, 8418.22.000, 8418.29.000 which need CFC-12, the import of CFC-12 shall be allowed up to December 31, 2003 at the maximum of 700 tons through an approved importer (IT).

(2) The company appointed as IT as meant in paragraph (1) shall be PT Dharma Niaga.

(3) Any import realisation by the IT as meant in paragraph (1) shall obtain approval from the Director General of International Trade based on the proposal of the Director General of Metal, Machine and Chemical Industries. "

"Article 5C

(1) The import of substances or goods as meant in Attachments I and II to this decree whose L/C was issued before December 31, 1997 shall arrive at the port of destination of Indonesia not later than June 30, 1998.

(2) The import of substances or goods as meant in paragraph (1) which enters Indonesia after June 30, 1998 shall be liable to sanctions pursuant to the provisions in force."

3. The other provisions stipulated in the Decree of the Minister of Industry and Trade No. 230/MPP/Kep/7/1997 shall remain valid.

Article II

This decree shall come into force as from the date of stipulation.

For public cognizance, this decree shall be announced by publishing it in the State Gazette of the Republic of Indonesia.
